1. Introduction and Acceptance of Terms
Welcome to Creative Heart Design. These Terms and Conditions govern your access to and use of the Creative Heart Design website, online store, digital products, physical products, custom design and illustration services, and related offerings, collectively called the Services.
In these Terms, Creative Heart Design is referred to as we, us, or our. By accessing the website, placing an order, downloading a product, or purchasing services, you agree to these Terms. If you do not agree, do not use the website or purchase or use the Services.
2. Eligibility and International Customers
You must have the legal capacity to enter into a binding agreement in the place where you live to use the Services. If you are under the age of majority in your location, a parent or legal guardian must place the order or provide any consent required by law.
Creative Heart Design serves customers in the United States and may accept orders from customers in other countries. You are responsible for confirming that purchasing, importing, downloading, accessing, or using the Services is lawful in your country or region.
3. Products and Services
Creative Heart Design may offer the following:
Physical products, including printed, personalized, handmade, or made-to-order items;
Digital products, including templates, downloads, graphics, artwork, printable files, and other digital content; and
Creative services, including custom artwork, branding, design, editing, consultations, illustration, and related work.
Product photos, mockups, colors, measurements, materials, descriptions, and samples are provided for general reference. Actual colors and appearance may vary because of screen settings, printing processes, materials, handmade production, personalization, and other factors.
4. Orders and Acceptance
Submitting an order is an offer to purchase. An order is accepted when Creative Heart Design confirms it, processes payment, or begins fulfillment. A confirmation email or payment receipt does not necessarily mean that every item in an order has been accepted if Creative Heart Design later identifies an issue requiring cancellation or adjustment.
Creative Heart Design may refuse, cancel, or limit an order at its discretion, including because of a pricing error, suspected fraud, product availability, incomplete or inaccurate information, or a violation of these Terms. If an order is canceled after payment, Creative Heart Design will provide any refund required by applicable law or otherwise offer an appropriate remedy.
You must provide accurate and complete order, personalization, shipping, contact, and payment information. Creative Heart Design is not responsible for delays, losses, or errors caused by incorrect or incomplete information that you provide.
5. Pricing, Payment, Taxes, Currency, and Fees
Prices are shown in the currency identified at checkout and may change without notice. Payment must be received before an order is processed unless Creative Heart Design agrees otherwise in writing.
You are responsible for all applicable sales taxes, VAT, GST, customs duties, import fees, brokerage fees, and other charges connected with your purchase, except to the extent applicable law requires Creative Heart Design to collect or pay them. International orders may be subject to duties and import taxes assessed by local authorities.
6. Physical Products, Production, Shipping, and Delivery
Processing and production times vary by product and will appear on the product page, at checkout, or in the order confirmation when applicable. Estimated delivery dates are estimates only and are not guarantees.
Shipping carriers, customs processing, severe weather, holidays, supply issues, address errors, and other events outside Creative Heart Design's reasonable control may delay an order. International orders may take longer to arrive and may require customs clearance or additional information from the customer.
If Creative Heart Design cannot ship an order within the time stated at purchase, or within a reasonable time if no time is stated, Creative Heart Design will provide notice and, where required by law, offer the available options for a revised shipping date or cancellation and refund.
Shipping responsibility and risk of loss are determined by applicable law and the shipping terms for the order. Customers should inspect deliveries promptly and contact Creative Heart Design about damage, defects, or incorrect items as soon as reasonably possible.
7. Digital Products and Downloads
Digital products are generally delivered by download link, email, customer account access, or another electronic method after payment is completed.
Digital-product sales are generally final once access or delivery begins, except where a refund or other remedy is required by law or stated otherwise in writing by Creative Heart Design.
Unless expressly allowed by the applicable product license, you may not:
Share, resell, redistribute, or sublicense a digital product;
Upload a digital product to a marketplace, file-sharing service, website, or other public or commercial location;
Reproduce a digital product for commercial sale; or
Claim ownership of a digital product or its underlying creative materials.
If a digital file is defective or inaccessible, contact Creative Heart Design within 7 days of purchase at [insert support email]. Include your order number and a description of the issue. Creative Heart Design may provide a replacement file or another appropriate remedy.
8. Custom Design and Illustration Services
For custom design and illustration services:
You must provide complete, accurate, and timely project information, content, feedback, approvals, and permissions.
Production timelines begin only after Creative Heart Design receives the required materials, payment or deposit, and project approval.
Revisions are limited to the number included in the purchased package or written agreement. Additional revisions, changes in scope, edits, and rush work may incur additional fees.
Before approving a proof or final deliverable, you must review spelling, dates, colors, sizing, layout, and all other details carefully.
Creative Heart Design is not responsible for errors approved by you or for changes requested after final approval.
Deposits, consultation fees, and custom-work fees are non-refundable once work has started, except where required by law or agreed in writing.
Creative Heart Design may use subcontractors, printers, production partners, or other service providers when reasonably needed to fulfill a project, while remaining responsible for its obligations under these Terms and any written project agreement.
9. Customer Content and Permissions
Customer Content means photos, logos, text, artwork, names, trademarks, and other materials that you provide to Creative Heart Design.
By providing Customer Content, you confirm that:
You own the content or have all necessary rights and permissions to use it and authorize Creative Heart Design to use it;
Its use will not violate another person's intellectual-property, privacy, publicity, contractual, or other rights; and
It is not illegal, defamatory, hateful, harmful, or otherwise inappropriate.
You grant Creative Heart Design a limited, non-exclusive, worldwide license to use, reproduce, modify, and display Customer Content only as needed to fulfill your order and provide the Services. You are responsible for Customer Content and agree to defend, indemnify, and hold harmless Creative Heart Design from claims arising from Customer Content you provide, to the extent permitted by law.
10. Returns, Refunds, Cancellations, and Exchanges
Creative Heart Design may describe additional details in a separate Refund and Return Policy, which is incorporated into these Terms by reference.
Unless otherwise stated or required by law:
Custom, personalized, made-to-order, and digital products are non-refundable;
Physical non-custom items may be eligible for return or exchange if requested within [insert number] days after delivery and returned unused, unopened, and in original condition;
Customers generally pay return shipping costs unless an item arrived damaged, defective, or incorrect because of Creative Heart Design's error;
Shipping charges, taxes, duties, and other non-product charges are generally non-refundable; and
Cancellation requests must be made promptly and cannot be guaranteed once production, personalization, fulfillment, or digital delivery has begun.

11. Intellectual Property and Licenses
Website content, branding, designs, artwork, text, graphics, photographs, logos, downloads, product designs, templates, and other materials owned or licensed by Creative Heart Design are protected by applicable intellectual-property laws.
Purchasing a product or service does not transfer ownership of Creative Heart Design's intellectual property unless Creative Heart Design expressly states otherwise in a written agreement.
For custom work, ownership and permitted use are controlled by the written project agreement, invoice, product description, or applicable license. Until all amounts are paid in full, Creative Heart Design retains all rights in the work to the extent allowed by law.
12. Prohibited Uses
You may not:
Use the website or Services for illegal, fraudulent, abusive, or harmful purposes;
Copy, scrape, reproduce, distribute, modify, reverse engineer, or exploit Creative Heart Design materials without permission;
Use Creative Heart Design content, products, or designs to create competing products or services;
Remove copyright, trademark, license, or other ownership notices;
Interfere with website security, systems, accounts, or other users;
Submit harmful code, spam, malware, or unauthorized automated requests; or
Misrepresent your identity, payment information, or authority to act for another person.
13. Reviews, Testimonials, Social Media, and User-Generated Content
When you submit a review, testimonial, photo, tag, or other user-generated content to Creative Heart Design, you grant Creative Heart Design a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and share that content for business, promotional, and marketing purposes, subject to applicable law.
You may not submit false, misleading, defamatory, abusive, or infringing content. Creative Heart Design may moderate or remove content at its discretion.
Creative Heart Design does not require customers to provide only positive reviews and does not prohibit honest reviews. You must clearly disclose material connections, such as compensation, free products, discounts, or affiliate relationships, whenever disclosure is required by law.
14. Third-Party Platforms and Links
The website may use or contain links to third-party websites and services, including payment processors, shipping carriers, social-media platforms, marketplaces, hosting providers, and other service providers.
Third parties are not controlled by Creative Heart Design. Creative Heart Design is not responsible for third-party content, policies, security, availability, or practices. Your use of a third-party service is subject to that service's own terms and privacy policy.
15. Privacy
Personal information is handled under the Creative Heart Design Privacy Policy. This Terms and Conditions Policy does not replace the Privacy Policy.
Creative Heart Design may collect and process information as needed to operate the website, process orders, communicate with customers, provide support, prevent fraud, protect the Services, and comply with legal obligations. If you are outside the United States, your information may be transferred to and processed in the United States or other countries where Creative Heart Design or its service providers operate.
16. Disclaimers and Consumer Rights
To the fullest extent permitted by law, the website, products, digital content, and Services are provided as is and as available, without warranties of any kind, whether express, implied, or statutory.
Creative Heart Design does not guarantee that the website will always be secure, uninterrupted, error-free, or available, or that digital files will work with every device, software program, printer, browser, or operating system.
Nothing in these Terms excludes, restricts, or limits consumer rights, remedies, or warranties that cannot legally be waived or limited in your jurisdiction.
17. Limitation of Liability
To the fullest extent permitted by law, Creative Heart Design and its owners, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of goodwill.
To the fullest extent permitted by law, Creative Heart Design's total liability relating to a claim will not exceed the amount you paid to Creative Heart Design for the specific product or service giving rise to the claim during the 12 months before the claim arose.
These limitations are subject to non-waivable rights and applicable law. Some jurisdictions do not permit certain exclusions or limitations, so some of these provisions may not apply to you or may apply only to the maximum extent permitted by law.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Creative Heart Design and its owners, employees, contractors, suppliers, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
Your use of the Services;
Your violation of these Terms;
Customer Content you provide;
Your infringement of another person's rights; or
Your unlawful, fraudulent, or harmful conduct.
19. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of [insert state], without regard to conflict-of-law rules, except to the extent applicable law requires otherwise.

Creative Heart Design is not responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, terrorism, labor disputes, carrier delays, customs delays, utility or internet failures, supply shortages, government actions, epidemics, or similar events outside its reasonable control.
21. Changes to These Terms
Creative Heart Design may update these Terms from time to time. The revised version will be posted on the website with a new effective date. To the extent permitted by law, your continued use of the website or Services after changes take effect means that you accept the updated Terms.
If a change materially affects your rights, Creative Heart Design may provide additional notice where required by law or reasonably appropriate.
22. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, invalid, or unlawful, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
These Terms, together with the Privacy Policy, Refund and Return Policy, product-specific terms, invoices, and written custom-service agreements, form the entire agreement between you and Creative Heart Design concerning the Services and replace prior agreements or understandings about the same subject matter, except where a written agreement expressly provides otherwise.
